Federal Judge Sachs Rules to Continue the Killing of Unborn Babies With A Heartbeat
The following statement may be attributed to Steve Rupp, President of Missouri Right to Life:
Today, Judge Howard Sachs issued a preliminary injunction enjoining a portion of Missouri’s strong pro-life legislation, HB 126, from going into effect. Long retired, Judge Sachs has a history of ruling for abortion. Given that history, Missouri Right to Life is disappointed but not surprised by this ruling.
The portion of HB 126 found so egregious by Judge Sachs is that our pro-life legislators would try to save babies with a heartbeat and that can feel excruciating pain during an abortion. Today Judge Sachs gave the abortion industry an open door to continue killing these babies with a beating heart.
Provisions of the law that will go into effect tomorrow are:
- An increase in tax credit to 70% of the donation and removes the state limit on tax-credits.
- A required increase in the malpractice insurance for those performing or inducing abortion, bringing it in line with medical standards.
- A requirement that abortion or family planning facilities, referring a woman to an out-of-state abortion facility, give that woman Missouri’s printed informed consent information.
- The ban on abortion when Roe v. Wade is overturned.
These provisions were never challenged by the ACLU and Planned Parenthood and therefore never came before Judge Sachs for a ruling.
Also going into effect tomorrow is the ban on abortion for reasons of race, sex and a Down Syndrome diagnosis. While this was challenged by the ACLU and Planned Parenthood, Judge Sachs limited this ban to viable babies.
Missouri Right to Life stands with the overwhelmingly pro-life legislature and our statewide, pro-life officials. Approximately 115 of 163 house members and 24 of 34 Senators are pro-life. 5 of 6 statewide offices are held by pro-life officials. The people of Missouri, through the election process have made their opinions on the sanctity of life very clear. The liberal courts stand in direct opposition to the will of the people of Missouri.
Governor Parson has made it clear that Missourians believe in the humanity of unborn children and that “Missouri Stands For the Unborn.” We call upon our Attorney General to appeal this egregious decision.
